Aid Paid Pending

Aid Paid Pending (APP) is the continuation of aid or services in the amount the claimant would have received if the proposed action was not taken. Benefits will continue in the amount authorized immediately prior to the notice of the adverse action.  

Determination of  Aid Paid Pending 

APP is granted in the following situations:
  • An adequate and timely Notice Of Action (NOA) was sent and the client files a request as follows: 
    • For State Programs - the request for appeal is filed before the proposed action takes place.
    • For General Assistance -  the hearing request is filed within seven (7) days of the date of the NOA.
  • An adequate NOA was not sent timely.
  • The NOA was sent timely but is found to be inadequate. 
  • A NOA was not sent. 
  • Refer to Notices of Action (NOAs) Overview for more information on adequate and timely NOAs. 

 

  APP is not granted in the following situations:
  An adequate and timely NOA was sent and the client files an appeal after the proposed action takes place.
  At initial application.
  Beyond the end of a CalFresh certification period. 


Upon receipt of a hearing request, the Appeals Office (AO) will make an APP determination based on:

  • Issuance of Notice of Action(NOA)
  • Validity of the NOA
  • Timeliness of appeal/hearing request.

Note: No APP shall be issued as a result of a change in:

  • Board of Supervisors policies

  • Agency regulations

  • State law

  • Federal law.

Issuance of Aid Paid Pending (APP)

APP payments are to be issued on a monthly basis in the same amount as the original grant received PRIOR TO DISCONTINUANCE OR REDUCTION.

APP will be issued as a continuing grant to both the claimant and the landlord (if needed for the  General Assistance Program). The effective date of APP is the date immediately following the CORRECT effective date of the adverse action (i.e., timely NOA).

 

Changes During APP Period 

Any changes occurring during the APP period require normal action from the Eligibility Worker (EW). Such changes may include, but are not limited to:

  • Processing  SAR 7s and the resulting changes
  • Processing recertifications/reinvestigations
  • Making budget changes
  • Sending NOAs
  • Discontinuing for reasons other than the one being appealed.

Claims Resulting from APP 

if the claimant unconditionally withdraws, or if the claim is denied or dismissed, any APP becomes an overpayment for any Cash Assistance program and an Inadvertent Household Error (IHE) overissuance for CalFresh, subject to adjustment and collections. For the Medi-Cal program, if the claimant unconditionally withdraws, or the claim is denied or dismissed, Medi-Cal overpayment(s) are not processed.

 

Example Example The claimant files for an appeal prior to the reduction date and receives the same benefits in the upcoming SAR Payment Period as they received in the current SAR Payment Period. The claimant loses the appeal. For both Non Assistance and Categorically Eligible households the APP results in an Inadvertent Household Error overissuance. The overissuance counts for the Categorically Eligible household because it is due to a change in the net income. 

Inter County Transfers Initiated With Active Aid Paid Pending 

Inter County transfers are to be initiated withing seven days of the claimant’s request. APP continues at the same benefit level during the transfer period. The receiving county is required to accept the transfer at the end of the transfer period and assume responsibility for any continued APP and for discontinuing APP.

 

APP General Assistance Automatic Hearings

APP shall be paid ONLY in Automatic Hearings under the following circumstances:

  • If the date of the hearing is later than the proposed discontinuance and sanction; or
  • If the automatic hearing is rescheduled.

Cessation of APP

Eligibility for APP stops when:

  • The claimant withdraws the hearing request.
  • The claimant does not appear for the hearing.
  • The client reschedules a hearing with no good cause.

Note: The Appeals Supervisor is responsible for determining good cause.

  • A hearing decision has been made.

NOTE: It is NOT necessary to send a NOA when APP stops.
