Overview [63-504.2]

Effective Date

The effective date of change is the date of the actual change to the household’s eligibility or benefit level.

ExampleExample

The household reports an increase in income on June 5 and the household is notified that their benefits will be decreased on July 1.  The effective date of this change is July 1.

EBT staggered issuance policies will not accommodate the need for additional time to issue a change in benefits NOA. Regardless of the household’s actual benefit issuance date, the effective date for a change in benefits is the 1st of the next issuance month.

Timely Notice [63-504.213]

A timely NOA is one which is mailed at least ten days prior to the effective date of the change.

TBenefits will be discontinued effective December 1. To be timely, a NOA must be mailed on or before November 20.

Adequate Notice [63-504.211]

An adequate NOA is one which is mailed anytime prior to the effective date of the proposed change.

ExampleExample

Benefits will be terminated effective December 1. To be adequate, a NOA must be mailed by November 30.

Waivers

Households may not waive their right to a timely or adequate NOA.

Requirements [63-504.211]

A NOA shall explain the:

  • Proposed action in easily understandable language
  • Reason for the proposed action
  • Right to request a State hearing
  • Availability of continued benefits
  • Potential liability for any overissuance received while awaiting a fair hearing
  • Complete State Manual section(s), including subsections, upon which the proposed action is based
  • Phone number where collect calls will be accepted from households living outside the local calling area.

Restrictions

Never tape pieces of other NOAs onto a NOA or photocopy a NOA.
