Implementation of Assembly Bill (AB) 116: Changes to Child Care Provider Rate Sheet and Reimbursement Rate Category

Background

Licensed child care providers must submit a copy of their rate sheets listing the rates they charge.  While California Code of Regulations (CCR) 5 CCR Section 18231 requires a "service provider" to submit this information, it does not specify whether this requirement applies to both licensed child care providers and license-exempt child care providers.    

 

5 CCR Section 18075 indicates full-time weekly and full-time monthly reimbursement rate categories can be used interchangeably to calculate reimbursement for a child who is certified for full-time child care services.  

Changes

Rate Sheets 

AB 116 amends WIC Section 10228(c) to specify that, effective immediately, license-exempt child care providers are not required to submit rate sheets.  Counties are to cease collecting rate sheets from license-exempt child care providers, and instead determine their reimbursement rate by referring to Child Care Service Regional Market Rates (RMR) Based on the 2021 Survey

 

Reimbursement Rate Categories

If a licensed child care provider's reimbursement rate is unable to be determined as either full-time weekly or full-time monthly, the provider should be reimbursed according to either of the following:

  1. The applicable rate category that most closely corresponds to the rate category listed on the licensed provider's rate sheet; or
  2. If unable to determine a single applicable rate category from the licensed provider's rate sheet, the applicable rate category that results in higher reimbursement is to be used. 

Forms

With this Update, the chart area on the "License-Exempt Home Certification/Registration" (SCD 1753) which asked license-exempt providers to list their rates has been omitted.  

Handbook Chapter

With this Update, the Child Care Service - Child Care Rates section in the CalWORKs Employment Services (CWES) Handbook has been updated.

Implementation

These changes are effective immediately.
