Receiving State or County Regulations

As part of the ICPC process, the receiving state compact administrator must determine if the proposed placement meets all of the receiving state's laws and requirements, including license and non-profit status, to approve the placement. To document that those requirements have been met, the County must require copies of the home's license or similar evidence of compliance from the receiving state.

The DFCS ICPC Coordinator serves as the liaison for the county and is in contact with the State of California’s ICPC Administrator. If the necessary licenser or approval information is not received along with the required documentation, the FC EW should contact the DFCS ICPC coordinator.

 

Effective May 13, 2024, all ICPC inquiries should be sent to the Department of Family and Children Services (DFCS) central ICPC email, DFCS-ICPC_SantaClara@ssa.sccgov.org or phone number 408-501-6850. 

 

The FC EW will check in the EW Tools/Resources folder for payment regulation information. If no information is on file, the EW will seek assistance from the Department of Employment and Benefit Services (FC MA to gather the necessary information. 

 

Rates and DEBS Management Analyst Role

The county must also obtain the appropriate rate for the placement from the receiving state's rate-setting authority. For an OOS foster family home placement, the receiving state's foster family home rate is to be paid.

If the receiving state has a specialized rate plan (SRP), their Special Care Increment (SCI may be paid if approved and when appropriate. If the receiving state does not have an SRP, the sending county's SCI may be paid in addition to the receiving state's foster home rate when approved.

The county is also responsible for determining if any non-allowable costs are included in the rate and ensuring that only allowable costs are claimed for federal or state AFDC reimbursement.

Allowable costs are defined as follows:

  • Food
  • Clothing
  • Shelter
  • Daily supervision
  • School supplies
  • The child’s incidentals
  • Liability Insurance with respect to the child
  • Travel cost for reasonable visitation.

Gathering Information for Payment

The DEBS MA is responsible for information gathering so the FC EW may issue the required payment. The EW requests information by completing the  “Out of State/County Request for Information” form (SCD 2213).

  1. FC EW
    1. Requests information from the DEBS MA by completing the “Out of State/County Request for Information” form (SCD 2213).
  2. FC MA
    1. Contacts the eligibility branch in the other state or county
    2. Collects the host state or county’s eligibility requirements including but not limited to:
      1. Placement requirements (for example licensing or home approval requirements)
      2. Foster Care and specialized care rates
      3. Clothing allowance (initial, annual).
    3. Forwards a copy of the information to the EW with the SCD 2213
    4. Files a copy of the information in the EW Tools Folder located on the shared drive. If the information received is in hard copy, it must be scanned and placed in the appropriate folder for future reference.

Note: There is no time restraint for gathering this information. It is often a lengthy process to contact another agency and receive the required information. 

Interstate Compact on the Placement of Children Report on Child’s Placement Status (ICPC 100B)

The sending agency shall complete form 100B and forward copies to the receiving agencies under the following circumstances:

  • When there is a change in the placement status of the child/youth
  • When placement is terminated for adoption
  • When there is any significant change in plans for the child/youth
  • The receiving state will not agree to supervise a NMD.

Foster Family Change of Placement

If a licensed caregiver relocates and the child is Title IV-E eligible, AFDC-FC funding shall be used until the caregiver completes licensure in the receiving state. Conversely, If the child is not Title IV-E eligible and the licensed caregiver moves, county-only funding must be used in this situation.
