Non-Citizens
The following are categories of Non-Citizens:
- A non-citizen with no documentation to prove their lawful presence or satisfactory immigration status (undocumented),
- A non-citizen legally admitted to the U.S. for a limited period (i.e., temporary visa),
- An applicant/client who has not provided acceptable proof of citizenship/identity at the end of the reasonable opportunity period (ROP),
- A non-citizen permanently residing in the United States under color of law (PRUCOL),
- Survivors of Human Trafficking or Serious Crime pursuing T Visa status (the client must at least have the intent to apply for the T visa),
- Survivors of Human Trafficking or Serious Crime and can verify that they have applied for or been approved U Visa status,
- Refugees,
- Asylees,
- Deferred Action for Childhood Arrivals (DACA),
- Conditional Entrants,
- Parolees,
- Deportation withheld.
Lawfully Present
Lawful presence indicates that a non-citizen has permission to remain in the country and has valid documentation.
Satisfactory Immigration Status
Satisfactory Immigration Status (SIS) indicates that a non-citizen has an immigration status that qualifies for federal public benefits.
These individuals are also referred to as Qualified Non-Citizens (QNCs) under the following statuses:
- Lawful Permanent Residents (LPRs) who are exempt from or have met the five-year bar,
- Cuban/Haitian Entrants,
- Migrants legally residing in the United States and its territories under the Compact of Free Association (COFA), such as citizens from the Marshall Islands, Micronesia, or Palau,
- Amerasian Immigrants.
SSN Requirement
Social Security numbers are not required for certain non-citizens who are not lawfully present.
- If the client's SSN is known from other means, i.e., already on file, on MEDS, on earnings statements, etc., it must be used for IEVS and for any other MC-related purpose.
- Follow current pseudo number procedures if the SSN is unknown.
Reminder: If an individual has an SSN and chooses to give this information or it is known from other means, the SSBS must record the SSN in SAWS. An IEVS applicant transaction is then generated.
Note: An SSN is not required for Victims of Human Trafficking and Serious Crimes to receive MC benefits. Refer to TCVAP.
