Non-citizens Eligible for Full-Scope MC Benefits
Individuals Eligible
The following non-citizens are potentially eligible for full-scope MC benefits:
- A non-citizen who has been lawfully admitted to the United States for permanent residence,
- A non-citizen permanently residing in the United States under color of law (PRUCOL),
- Survivors of Human Trafficking or Serious Crime pursuing T Visa status (the client must at least have the intent to apply for the T visa),
- Survivors of Human Trafficking or Serious Crime and can verify that they have applied for or been approved U Visa status,
- Refugees & Asylees (granted Asylum),
- Deferred Action for Childhood Arrivals (DACA),
- Any individual aged 19-25 after January 1, 2020,
- Any individual over age 50 after May 1, 2022,
- Any individual aged 26-49, regardless of immigration status, after January 1, 2024.
Important: Eligible individuals cannot opt out of full-scope MC.
Canadian Born American Indians
- American-Indians born in Canada, provided that they are at least 1/2
- American-Indian ancestry are considered to be lawfully admitted for permanent residence. American-Indian ancestry must be verified by a birth or baptismal certificate issued on a Canadian
- Indian reservation, tribal, or school records which establish that an American-Indian born in Canada is of at least 1/2 American-Indian ancestry.
Note: USCIS will issue Form I-551s to American-Indians born in Canada.
