8 - Agency Error Process

The Employment Counselor (EC) must follow the following process when an Agency Error has occurred:

If... Then...
It is determined BEFORE the hearing that an Agency Error occurred,
  • Contacts the Appeals Officer (AO) to cease the non-compliance process and to cancel the Fair Hearing
  • Enters case comments in VSAS Narrative and CalSAWS Journal following internal process.
It is determined AFTER the hearing that an Agency Error occurred,
  • End-dates the sanction in CalSAWS
  • Changes the disposition code in VSAS
  • Completes Social Services Benefits Specialist/Vocational Services Communication (GA 53) and forwards it to clerical staff to create Task for SSBS to take appropriate action
  • Enters case comments in VSAS Narrative and CalSAWS Journal following internal process.

Note: ECs may only change hearing dispositions for cases that were not heard by the Hearing Officer, such as; for individuals who fail to show for the hearing. 
For cases heard, if the claimant is dissatisfied with the decision of the Hearing Officer he/she may request an Administrative Review by the Director of the Social Services Agency or his/her designee. Refer to Administrative Review for more information.
