Agency Error Process
The EC:
- If it is determined BEFORE the hearing that an Agency Error occurred,
- Contacts the Appeals Officer to cease the non-compliance process and to cancel the Fair Hearing
- Enters case comments in VSAS and CalSAWS Journal following internal process
- If it is determined AFTER the Fair Hearing that an Agency Error occurred,
- End-dates the sanction in CalSAWS,
- Changes the disposition code in VSAS,
- Completes GA53 and forwards to clerical staff to create Task for EW to take appropriate action
- Enters case comments in VSAS and CalSAWS Journal following internal process.
NOTE: ECs may only change hearing dispositions for cases that were not heard by the Hearing Officer, such as; for individuals who fail to show for the hearing.
For cases heard, if the claimant is dissatisfied with the decision of the Hearing Officer he/she may request an administrative review by the Director of the Social Services Agency or his/her designee. Refer to Administrative Review for more information.
