Reapplication After Receipt of Substantial Lottery or Gambling Winnings
When a household reapplies after being discontinued as a result of receiving a substantial lottery or gambling winnings the household must not be considered CE or MCE. The household is subject to the regular CalFresh gross income test (except for households with elderly and/or disabled members), net income test, and resource test. This requirement only applies the first time a regular household is certified following the loss of eligibility for substantial lottery and gambling winnings, regardless of the length of the time between the discontinuance and reapplication.
A household is discontinued with a timely notice after receiving and reporting a substantial lottery or gambling winning in March. In May the household reapplies and must pass the regular CalFresh rules. CalFresh gross income test (except a household that includes an elderly or disabled individual), net income test, and the resource test must be met in order to be certified for CalFresh benefits. This household is not eligible to be considered CE or MCE at reapplication.
Household Composition Change at Reapplication
If the household composition has changed or an individual household member chooses to reapply alone or as a member of another CalFresh household subsequent to a discontinuance for substantial lottery or gambling winnings, then this household must be considered a distinctly different household from the household that was discontinued due to substantial winnings. This household composition change created a new and distinctly different household from the household that had substantial winnings. This includes when the primary and sole applicant for CalFresh is the winner of the substantial winnings. The distinctly different household must be treated as any other household that applies for CalFresh. Therefore, the household is not subject to the regular CalFresh rules and may be considered CE or MCE when they apply.
