When Required

AFDC-FC redeterminations are required annually. The annual RD change from six months to annually did not change other foster care requirements which must be reviewed every six months, such as periodic reviews, case plan updates, and TILP. In addition, it did not change the requirement that a current “Foster Child’s Data Record and AFDC Certification” (SOC 158A) must be completed for court dependent children annually as a part of the RD process.

Redetermination of Deprivation

A child is considered deprived of parental support when care for the child is unavailable because of death, physical or mental incapacity, unemployment or absence of the child’s parent(s). Deprivation must be determined during the Intake process but not during the RD process.
ACL 22-16 also clarifies that income and resources are not to be evaluated during the RD. This provision does not remove the other federal requirements such as licensing, home approvals, and an updated SOC 158A.

Once Non-federal or State deprivation is determined it remains the authority for placement until the age of 18 years old or 21 years old when participating in the EFC.

Who Completes the Foster Care RD

All children, youths and NMD and NMFD receiving AFDC-FC foster care benefits must have an annual RD completed by the FC EW, along with the assigned SW, PO, NMD or LG.

Parents and Legal Guardians and Court Dependent Children

All RD documents are sent and must be completed by the assigned SW/PO for court dependent children. All SW/PO must complete the “Statement of Facts Supporting Foster Care Eligibility for AFDC-FC” (FC 2). The parents’/guardians’ cooperation is not required to compete the RD process.

Non-Minor Dependents (NMD)

NMDs in the EFC Program must complete the “Statement of Facts Support Eligibility For Extended Foster” (FC 2NM) at the annual RD unless the SW/PO has determined the NMD is unable to complete the document. When the NMD is not able to complete the FC 2NM, the SW/PO must complete the document.

When the NMD is placed in a SILP the “Supervised Independent Living Placement Approval and Placement Agreement” (SOC 157A) and “SILP Inspection Check List” (SOC 157B) must also be completed.

Non-Court Dependent and Probate Legal Guardians

When court dependency has been dismissed and when guardianship is established through probate court, these placements do not have an assigned SW/PO, therefore the LGs must complete the required RD documents.

To expedite the RD process the FC EW will schedule an appointment with the LG prior to the RD date. An appointment is not required but is advisable to expedite the RD process and to avoid disruption of benefits.
