Background
Assembly Bill 133 added sections to the Welfare and Institutions code and established a two-phase approach to eliminating the asset limit for Non-MAGI Medi-Cal recipients. The first phase, which became effective July 1, 2022, increased the asset limit to $130,000 per person and $65,000 for each additional household member (up to a maximum of ten people). The second phase will eliminate the asset limits for all Non-MAGI MC programs.
Changes
Effective January 1, 2024, asset limits are eliminated and should not be used in determining eligibility for Non-MAGI MC programs at application, redetermination, or when a change in circumstance is reported. The elimination of assets applies to all Non-MAGI programs, including Long Term Care and Medicare Savings Programs. All Medi-Cal policy guidance remains in effect for eligibility determinations prior to implementation on January 1, 2024. Individuals who are evaluated for benefits in the month of December 2023 and are over the asset limit at that time shall be evaluated for eligibility for the month of January 2024 and ongoing.

Any forms referencing resources or property will be updated in the SAWS system.
Data Systems
SAWS will make programming changes to eliminate asset limits when determining eligibility for MC programs by January 1, 2024. No new Notices of Action (NOAs) will be created for this policy change. The SAWS will update existing NOAs to remove any references to denying or discontinuing a Non-MAGI individual due to exceeding the asset limit or for failure to provide asset information.

This change only affects the Medi-Cal program.
