Child Care Discontinuance
Immediate and Continuous Child Care in CalWORKs Stage I may be discontinued under any of the following circumstances:
- The participant is transferred to Stage II, and confirmation is received from the Alternative Payment Program (APP) that the family is enrolled in Stage II.
- A participant who initially is certified as income eligible voluntarily reports income that exceeds the threshold for ongoing eligibility pursuant to Welfare institution Code Section 10271.5.
- An exempt participant initially volunteers to participate, and does not sign a Welfare-to-Work (WTW) plan to participate in activities or later decides not to volunteer to participate.
- A sanctioned participant who does not have an existing child care authorization indicates an intent to cure their sanction but later fails to participate.
- The family moves out of state.
- Client requests discontinuance.
Prior to 24-Month Period
Issue a Notice of Action Child Care Services Discontinuance (NA 835) for a discontinuance reason that takes place prior to the end of the 24-month period, such as when a client is transferred to Stage II Child Care, or when a client is discontinued due to income exceeding 85% of the state median income for the family size.
When the notice is not issued through CalSAWS, a copy of the Notice of Action (NOA) MUST be forwarded to Imaging. It is the client’s responsibility to communicate this information to the provider.
Note: A timely NOA (10-day) must be issued in instances when the child care subsidy is decreased or discontinued.
At the Conclusion of 24-Month period
Child care is approved and recertified in 24-month intervals. Evaluate the need for another 24-months of continuous child care 30 days prior to certification ending. A new CalWORKs Stage One Child Care Authorization Form (CCP 8) needs to be issued. The Associate Employment Counselor (AEC)/Employment Counselor (EC) should be reviewing eligibility for the new certification period 30 days prior in order to either issue a new CCP 8 or an NA 835. An NA 835 needs to be sent anytime child care is not to be recertified.
When any of the following applies at the end of the 24-month period, issue an NA 835 within 10 days:
- Welfare-to-Work (WTW) mandatory participant stopped attending their WTW activity.
- A WTW mandatory participant intended to cure their sanction and signed a curing sanction plan but stopped attending their WTW activity.
- An exempt volunteer who signed a WTW Plan stopped attending their WTW activity.
- The case has been discontinued from cash aid.
- Has a child who no longer needs child care or meets the age requirements.
- In a two-parent case, the other parent is no longer participating and is able and available to provide care.
- Per the client's request.
