Noncompliance - Supervisor Review
Right to a Review
The individual will be informed of the right to request a CalWORKs Employment Services Supervisor review of a determination of no good cause.
Reversal of No Good Cause
During the 20-day compliance period, if the CalWORKs Employment Services Supervisor reverses the "no good cause" determination by the EC, the supervisor will select Yes from the Good Reason drop list and make a selection from the Good Reason Type drop list in the WTW Status Detail page of the Non-Comp status. [Refer to "Noncompliance Process Guidance/Participant Has Good Cause While in Noncompliance" for additional information.]
Note: The Good Reason and Good Reason Type drop lists will only appear during the 20-day compliance period. Once the 20-day compliance period ends, the user will not be able to add Good Cause. Instead, the supervisor will need to manually add the WTW program status of Active.
During the compliance plan, if the client does not complete the terms of the "Welfare-to-Work Compliance Plan" (WTW 32) due to good cause, the supervisor will select Excused from the Non Completion Result drop list and make a selection from the Main Difficulty drop list in the WTW Status Detail page of the In Conciliation status reason. [Refer to "Noncompliance Process Guidance/Participant does not complete the terms of the WTW 32 due to Good Cause, the Worker/Supervisor updates the Non-completion result to Excused" for additional information.]
The CalWORKs Employment Services Supervisor documents the following information on the Journal Detail page in CalSAWS:
- That the initial determination of no good cause has been reversed following supervisor review, and
- That the compliance plan has been terminated, and
- The applicable good cause reason which has led to the reversal of the no good cause determination.
No Good Cause Upheld
If the CalWORKs Employment Services Supervisor upholds the determination of "no good cause", the supervisor will document the following information on the Journal Detail page in CalSAWS:
- That the initial determination of no good cause by the EC has been upheld by a supervisor, and
- That the individual must comply with the compliance plan agreed upon by the individual and the county.
