Noncompliance - Unsuccessful Compliance Process

No Compliance Plan

An individual who has not resolved a participation problem, or has failed to agree to a compliance plan by the end of the 20th day of the compliance process period will be sanctioned.

If the individual refuses to sign a compliance plan by the end of the 20th day and the CalWORKs Employment Services Supervisor/Lead has implemented the sanction, the EC will issue the “Request to Meet Welfare to Work Rules to Get My Cash Aid Back” (WTW 31) and “Would You Like to Have Your Cash Aid Back” (SCD 194) to the individual.

Failed Compliance Plan

An individual who is unable to meet the conditions of her/his compliance plan (NA 817) will be responsible for notifying the EC immediately.

If an individual does not fulfill the terms of a written compliance plan agreed upon with CWES, and it is determined, based on available information, that the individual did not have good cause for failure to meet the terms of the compliance plan, the county will impose a sanction.

Note: When the compliance plan is failed, the NA 817 date of sanction cannot be changed to a date prior to the date on the corresponding "Sanction of Mandatory Participant" (NA 840).

If a sanction is imposed under the terms of this paragraph, no further compliance procedures are applicable.

“Sanction of Participant After Failed Compliance Plan” (NA 817) Notice

At any time during the compliance process, if a first parent fails to participate in the activity on the compliance plan, without good cause, he or she will be sanctioned. The county must issue a timely NA 817. The NA 817 is used when sanctioning the first parent who has agreed to sign a compliance plan, but then fails to meet the terms of the plan. When completing the NA 817 from the DEBS Forms Library, include the NA 200 budget or NA 1239 SAR budget form, “Request to Meet Welfare to Work Rules to Get My Cash Aid Back” (WTW 31) and “Would You Like to Have Your Cash Aid Back” (SCD 194). Refer to Common Place Handbook, "Timely Notice" for additional information.  

“Sanction of Second Parent After Failed Compliance Plan” (NA 816)

The NA 816 is issued timely when sanctioning the second parent who has agreed to sign a compliance plan, then fails to meet the terms of the plan. When completing the NA 816 from the DEBS Forms Library, include the NA 200 budget or NA 1239 SAR budget form, “Request to Meet Welfare to Work Rules to Get My Cash Aid Back” (WTW 31) and “Would You Like to Have Your Cash Aid Back” (SCD 194).

“Suspension of Volunteer After Failed Compliance Plan” (NA 818) Notice

The NA 818 is used when sanctioning an exempt volunteer who has agreed to sign a compliance plan, then fails to meet the terms of the plan.
